If necessary, we will obtain an extract from the debt enforcement register and the land register, because debt enforcement is rarely successful with highly indebted debtors. Even if you already possess a foreign enforceable title such as a judgment or a notarial deed, the debtor can temporarily block enforcement proceedings in Switzerland. The creditor then has access to a special court procedure (known as a "legal opening procedure") to immediately prove their claim so that enforcement can proceed. As part of this process, a recognition procedure (exequatur) must also be carried out in Switzerland with regard to the foreign enforceable title.
A similar legal procedure exists for contracts signed by both parties.
