Another favorable court decision IN BRAZIL for ShareWood eucalyptus tree buyers

For the second time, a court in Brazil (Mato Grosso) has provisionally ruled in favor of the tree buyers represented by Dr. Fassbender Rechtsanwälte - this time there may even be hope of compensation for the injured parties who purchased eucalyptus trees from ShareWood Switzerland.

We have just received the news from our Brazilian colleagues that we have achieved a preliminary success in our recently initiated proceedings against the landowner of a large eucalyptus plantation for an injunction. This second very important interim success of our activities in Brazil in this matter has the concrete consequence that the landowner sued by us has been ordered by the court to refrain from harvesting eucalyptus with immediate effect and to no longer deny the plaintiffs and their appointed representatives access to the plantation areas on the Fazenda Emmanuel. Defendant is further ordered to provide a detailed report of all logs/trees harvested, shipped and sold within 15 (fifteen) business days along with the corresponding invoices.
The defendant farm owner, who is now no longer allowed to utilize the trees purchased by our clients from ShareWood Switzerland AG i. L., must also account for the unlawfully obtained income.
In addition, the care of the younger trees, which were exposed to considerable damage potential without this care, can now finally be organized again.
We would like to emphasize that this judgment in Brazil was issued only a few days after the lawsuit was filed on behalf of our clients and protects our clients' interests very effectively for the time being.
In addition, our action will undoubtedly send a signal that illegal appropriation of trees sold by ShareWood to our clients will not go unnoticed and unpunished.
It is good to see that this highly complex case, in which quite a few people had already given up, has given rise to hope that our many efforts for the tree buyers who were left in the lurch may not be in vain after all. +++

Nous venons d’apprendre de nos collègues brésiliens que nous avons obtenu un succès provisoire dans la procédure en référé que nous avons récemment entamée contre le propriétaire terrien d’une grande plantation d’eucalyptus. Ce deuxième succès intermédiaire très important de nos activités au Brésil dans cette affaire a pour conséquence très concrète que le propriétaire terrien que nous poursuivions en justice s’est vu ordonner par le tribunal de cesser immédiatement la récolte d’eucalyptus et de ne plus refuser aux plaignants et aux représentants qu’ils ont désignés l’accès aux terres de la plantation sur la fazenda Emmanuel. Il est également ordonné au défendeur de fournir, dans un délai de 15 (quinze) jours ouvrables, un rapport détaillé sur toutes les grumes/tous les arbres récoltés, expédiés et vendus, accompagné des factures correspondantes.
Le propriétaire de l’exploitation agricole, qui n’a plus le droit d’exploiter les arbres achetés par nos clients auprès de ShareWood Switzerland AG i. L., doit en outre rendre compte des revenus indûment perçus.
En outre, l’entretien des arbres plus jeunes, qui étaient exposés à un potentiel de dommages considérable sans cet entretien, peut enfin à nouveau être organisé.
Nous tenons à souligner que ce jugement au Brésil a été rendu quelques jours seulement après le dépôt de la plainte pour nos clients et qu’il protège provisoirement très efficacement les intérêts de nos clients.
De plus, notre action montrera sans aucun doute que les appropriations illégales d’arbres vendus par ShareWood à nos clients ne restent pas sans suite.
Il est bon de constater que ce cas très complexe, dans lequel beaucoup avaient déjà baissé les bras, suscite encore l’espoir, grâce à des mesures appropriées, que nos multiples efforts pour les acheteurs d’arbres abandonnés ne seront peut-être pas vains. +++
