Dr. iur Marcel Fassbender has more than 15 years of experience as head of the legal department and vice president in the senior management team of a global company implementing major projects in the infrastructure sector.

In this capacity, Dr. Fassbender was responsible for the commercial and legal management of up to 40 lawyers in the Group's various national offices. He not only had worldwide responsibility for the legal basis of the contracts, which often had a volume in excess of €1 billion, but also had extensive commercial responsibility for the financial assessment of the forecasts for key elements of the project work. At the same time, Dr. iur. Fassbender was also managing director of various subsidiaries of the group, e.g. in India, the Scandinavian countries, Israel, Switzerland and Germany.

Dr. Fassbender was also trained and certified as a business coach and mediator and took on additional tasks within the Group in cooperation with the HR departments. At the same time, he supported his wife, attorney Nicole-Denise Fassbender, in her own law firm, which they currently run together in Meilen (ZH) and Konstanz.

Dr. iur. Marcel Fassbender is admitted to practice before all German District Courts, Regional Courts and Higher Regional Courts and is registered in Switzerland on the list of attorneys pursuant to Art. 28 BGFA and may therefore represent parties before Swiss judicial authorities on a permanent basis. He is a member of the Freiburg Bar Association. Dr. Marcel Fassbender has proven experience as an advisor in complex, also international contract constructions. He not only drafts such contracts, but also proposes contractual strategies to his clients and conducts lengthy contract negotiations in English and German.

However, his work for various national and international clients does not begin with the revision of contracts and the preparation of draft contracts, but already in the bidding phase. His experience in the field of public tenders and his expert assessment of the risks and opportunities of given contracts are highly valued by his clients. In the past, he has led commercial contract management for various clients and developed new and modern procurement contracts for major public projects.

At the same time, Dr. Fassbender has particular expertise in setting up legal departments, identifying young and experienced talent in the field of law and commercial management (claim management). He has successfully built and restructured several legal departments. In doing so, Dr. Fassbender has shown great intuition not only in identifying and recruiting highly qualified and experienced legal advisors, but also in paying particular attention to the commercial and communication skills of such employees and their integration into the overall commercial context of the client.
Dr. Fassbender is also in demand as an interim manager and has in the past provided temporary support to SMEs in various functions up to and including management. As a (business) coach and experienced businessman, he is also available to CEOs and other decision-makers, offering his experience in difficult business and private matters.

As a mediator, he has conducted several business mediations, both alone and with Nicole-Denise Fassbender, attorney at law. In some cases, he has been able to resolve long-standing disputes between companies that were contractually bound and therefore in dispute, without resorting to the courts. Some of these mediations have resulted in the resumption of business relations between the companies previously in dispute. His long-standing network of international and national lawyers allows him to take on mandates far beyond Switzerland and Germany.
